These terms and conditions (together with the documents referred to in them) set out the terms on which you may make use of our domains www.skdjgroup.com or www.skdjgroup.co.in, and any other sites or mobile application operated by us (“sites”), whether as a guest or a registered user. Use of our sites includes accessing, browsing or registering to use our sites.

The sites are owned by SKDJ Group (the “Group” or “we” or “our” or “us”, which expressions shall mean and include any entity of the SKDJ Group and all its other affiliates, associates, joint ventures or related or connected entities, as applicable).

Any person logging into or using the Sites (“you” or “user”) shall be presumed to have read the Sites Terms and Conditions (which includes the Terms of Use provided hereunder and also the Disclaimer and the Privacy Policy, provided separately on the Sites) and has unconditionally accepted the terms and conditions and agree that be same shall be binding upon you.

The User’s use of the sites and services and tools are governed by the Terms and conditions as applicable to the Sites including the applicable policies which are incorporated herein by way of reference. By mere use of the Sites, the User shall be under a binding obligation to comply with these terms and conditions including the policies mentioned hereinafter.

By proceeding to view our sites or any part of it, you acknowledge that you have read, understood and accepted the terms and conditions of the sites. These terms and conditions may be changed or modified by us from time to time without any prior information to the user and the revised terms will be deemed to apply at the relevant time in respect of the use of our sites by the user.

Please read these terms and conditions carefully before you start to use our sites, as these will apply to your use of our sites. If you do not agree to these terms, you must not use our sites.

ELIGIBILITY

Any user who is above 18 (eighteen) years of age and competent to contract under applicable law is eligible to log into or use the sites or purchase the units in any project. Your use or access of the Sites shall be treated as your representation that you are competent to contract, and if you are registering as a business entity, you represent and warrant that you have the authority to bind such business entity to the Terms of Use.

The User represents and warrants that the User will be financially responsible for all of Users use of the Sites (including the purchase of units in any project) and access of the Sites (as well as for use of Users account by others). The Terms of Use shall be void where prohibited by applicable law, and the right to access the Sites shall automatically stand revoked in such cases.

ACESSIBILITY

For the purpose of these Terms of Use, wherever the context so requires “User” or “You” shall mean any natural or legal person who has agreed to these Terms of Use on behalf himself or any other legal entity.

Our sites are made available free of charge.

If you are provided with a user identification code, password or otherwise as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms. 

We do not guarantee that our sites, or any content on them, will always be available or be uninterrupted. Access to our sites is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our sites without notice. We will not be liable to you if for any reason any of our sites are unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to our sites. You are also responsible for ensuring that all persons who access our sites through your internet connection are aware of these terms and other applicable terms and conditions and that they comply with them.

ACCURACY OF INFORMATION ON OUR SITES

Specifications and amenities mentioned on our sites are only representational and informative. The viewer confirms that the information including, images, visuals, drawing plans or sketches, brochures and other marketing collaterals on our sites are only an architect’s impression and are only indicative of the envisaged developments and the same are subject to approvals from local authorities and that the viewer has not relied on this information for making any booking/purchase in any project of the Company. Nothing on our sites constitutes advertising, marketing, booking, selling or an offer for sale, or invitation to purchase a unit in any project by the Company. The Company is not liable for any consequence of any action taken by the viewer relying on such material/ information on our sites. Please contact our Sales Representatives for the updated sales and marketing information and collaterals in relation to Company’s projects.

The artistic works contained in our sites including but not limited to 360 degree view, Virtual Reality applications, walkthrough, E-brochures, Images, etc. are for representation purpose only and do not form a part of any agreement or legal binding on part of the Company. Shown views are not a part of the actual deliverables. Soft furnishing/furniture, gadgets, interior designing used in the flat/unit plan and images are only for representation purpose. The picture of the proposed residential flat/unit and all furniture, fixtures, items, electronic goods, amenities, landscaping, accessories etc. specified therein are only for the purpose of show casing the residential flat/unit and the Company is not liable / required to provide any furniture, items, electronic goods amenities, accessories etc. as displayed in the pictures. The extent/number/variety of the equipment/appliances and their brand thereof is tentative and liable to change at sole discretion of the Company. User or any person claiming under the User shall not have any right to raise objection in this regard. Actual product/ development and any other aspect may differ from what is portrayed herein. All layouts, plans, specifications, dimensions, designs, measurements and locations are indicative and not to scale and are subject to change as may be decided by the company or competent authority. Revision, alteration, modification, addition, deletion, substitution or recast, if any, may be necessary during construction. The Company reserves rights to make additions, deletions, alterations or amendments as and when it deems fit and proper, without any prior notice. No representation or warranty is made or intended as to the accuracy or completeness of information and no commitments are being given under the sites as to its suitability or adequacy for any purpose or otherwise howsoever.

The relationship between the Company and the actual customers will be governed strictly by the agreements to be executed from time to time and not on the terms of this sites. All details and prices quoted are indicative and have been calculated on basic rate.

In no event shall the Company and its related, affiliated and subsidiary companies be liable for any direct, indirect, special, incidental, or consequential loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising out of reliance on or use of the information contained herein.

INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in our sites, and in the material published on them. You acknowledge and accept that all of the copyright, database rights and any other intellectual property rights which subsist in the design, layout, processes, functions, data and content of our sites are the property of SKDJ or our licensors, information providers or contributors and we reserve all our rights in the same. No part of our sites, their content or any of their underlying software and databases may be copied or reproduced, shared with third parties, reverse engineered, reverse assembled, or used to create any derivative work (whether in physical or electronic form) without our prior written consent. 

You may print off one copy and may download extracts of any pages from our sites for your personal use and you may draw the attention of others within your organization to content posted on our sites. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. 

Our status (and that of any identified contributors) as the authors of content on our sites must always be acknowledged. You are not permitted to publish the contents of our sites including but not limited to publication on any other sites or computer environment. You must not use any part of the content on our sites for commercial purposes without obtaining a license to do so from us or our licensors. 

If you print off, copy or download any part of our sites in breach of these terms, your right to use our sites will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

LIMITATION OF OUR LIABILITY

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Indian law. 

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our sites or any content on them, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: use of, or inability to use, our sites; or use of or reliance on any content displayed on our sites.

If you are a business user, please note that in particular, we will not be liable for: loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

If you are a consumer user, please note that we only provide our sites for domestic and private use. You agree not to use our sites for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. 

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our sites or to your downloading of any content on it, or on any sites linked to it.

VIRUSES

We do not guarantee that our sites will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programs and platform in order to access our sites. You should use your own virus protection software.

You must not misuse our sites by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our sites, the server on which our sites are stored or any server, computer or database connected to our sites.

By breaching this provision, you would commit a criminal offence under the Information Technology Act, 2000. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our sites will cease immediately.

Where our sites contain links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources. We assume no responsibility for the content of sites linked on our sites. The Company cannot and does not monitor the sites linked to its pages on the Internet. Such links should not be interpreted as endorsement by us of those linked sites. Accordingly, the Company assumes no responsibility for the content of any site referenced to by any link or otherwise.

We will not be liable for any loss or damage that may arise from your use of them.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to our site in any sites that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. 

We reserve the right to withdraw linking permission without notice.

RE-MARKETING

Our sites use a remarketing advertising service. Our remarketing service is provided by Google and other companies that show our ads on sites across the Internet. With remarketing, you may see ads for our products you have previously looked at. As an example, when you visit another site that works with Google, or other providers of remarketing advertising, you may see ads for products you previously viewed.

Our Privacy Policy which sets out the terms on which we process any personal data we collect from you or that you provide to us. By using our sites, you consent to such processing and you warrant that all data provided by you is accurate.
